Apple wins patent infringement claim

Apple has recently won a patent infringement case against, health technology company, Masimo following a five-day trial. 


Apple brought a number of patent infringement claims against Masimo, all mainly related to the Signal Extraction Technology (SET), which monitors the wearer’s pulse and blood-oxygen levels, and is used in a number of Masimo devices. The judgment stated that Masimo has infringed on two of Apple’s patents within Masimo’s charger and the health module in their watches. However, neither of these are currently part of Masimo’s available products. 


Apple was not seeking a licence from Masimo to use the technology; only $250 in damages, which is the statutory minimum, and a statement from Masimo acknowledging the intentional copying of the patent, to demonstrate their intention in bringing the claim being to prevent Masimo’s smartwatch sales. The latter, however, was not awarded through an injunction.


Apple has suggested that they plan to appeal to ensure Masimo does not infringe further.
